He gave a ticket to the wrong car

Long story short. While driving back from my old school I was in the right hand lane going 65-68 in a 65 MPH zone (highway) just floating back home and a silver civic blows by me. No big deal right? WRONG. A few minutes later a State Trooper merges onto the highway and proceeds to pull me over. At this time I think nothing other than; I'm young, it's early, my car looks like a kids car.....DUI check.
So I pull over and here is how the dialogue went:
Officer: "NJ State Police License and registration"
Me: "Here you are officer."
O: "What's the hurry?"
M: "What do you mean?"
O:"I clocked you doing
92"
M:"

What? I have been in this lane the entire time going 65MPH?"
O: Smirking "I clocked you doing 92. This will only take a minute."
Then proceeds to give me a ticket for 92 in a 65 and returns to my car
O: "Here's all your items and your ticket."
M: "I was not going 92, there was a silver civic that passed me."
Then he said he was not going to argue.
So, now what do I do try to fight it myself or get a lawyer?
I'm just pissed that he actually gave me the ticket and i was not speeding.[/u]

Yeah, fight it. If it took minutes for the cop to pull onto the road then he should have known the guy he clocked was long gone.

Yes it was in the morning 8:05. If he "shot" me he should have record of it and if he pased(sp?) me the dash cam should have it on record as well
here is my case so far... its still very raw
I was in the right hand lane with other motorists around me and in front of me.
Driving at 92 MPH would have caused me to drive erratically. I would not have enough time to increase and decrease speed at that rate without applying my brakes heavily and/or changing lanes.
The civic, which resembles my car very well, passed me without hesitation 5 minutes before the Trooper merged on to the highway.
Now, there was another officer speed trapping after an over pass. I am assuming that he told the merging officer that there was a silver sedan traveling at speeds in excess of 90 MPH. At that rate of speed the civic was traveling it would be hard for the officer to identify the make of the car. Since my car was
A silver sedan, I was held liable for the accusation. There is no proven data that I was speeding.

But yea, that shit sounds so fucking retarded. I hate fucking cops. I don't know who knows the rules and shit about military servicemen/women and expired licenses (and I think I posted a thread a while ago), but this lady officer gave my buddy a ticket for driving with an expired license a week or so after we got back from Afghanistan. And wouldn't let me drive my buddy's car home cause mine's expired too. Such bullshit cops man, I swear.
Fight that shit bro. And fuck that cop in the ass

... lol.

Second note..
While I believe the officer was wrong it was a misunderstanding between him and the supporting officer.
I am in no way shape or form discrediting the officer nor am I degrading his character as a New Jersey State Trooper or as a human being.

Get a lawyer and go to court. The lawyer will know how to retrieve the dash cam footage, The officers records, the radar calibration records, etc.....
Dickhole cops give the rest of them shitty names. Hopefully it was just an equipment malfunction or he honestly didn't know but it really doesn't sound like that's the case. Radar units are not very accurate (compared to laser) and can easily be affected by other cars and the angle at which it hits the targeted car.

Postpone the court date once and get a lawyer. Most police officers aren't able to make it to court if it's postponed, and your lawyer will get you off regardless.

Should go down as a communication error and when the camera is checked it will be a completely different car unless the cops car was positioned to where the front was not pointed at the road.

what i'm wondering, is why everyone hates cops? so, a cop stopped you for 85 in a 70 one time and ticketed you? BOO-FUCKING-HOO, you did it to yourself! no, i'm not saying the OP was at fault in this thread, and YES cops make mistakes, noone is perfect, but just because one cop made a mistake, you're gonna hate on every cop? i used to have the SAME mentality, until i realized, if i don't drive like a fucktard, they'll leave me alone, i held a clean record for over 2 years, after having a string of tickets a mile long, resulting in my license being suspended, but now that i look back, i did it ALL to myself, so i can't hate.

I think you have a good chance of winning this in court..... with a lawyer, of course.
To me, it sounds like the trooper really screwed this up. I think that a good lawyer would be able to pick him apart, in a courtroom, and get your ticket dismissed.

nice going with the pics. I support what everyone has said. Fight it. I think its pathetic that police of all people can't tell the difference between cars. I can sometimes tell the difference in cars just with the way their headlights are at night time when I drive by. I think you will win this case easily because who would make up a dumb story like that anyways. Also you can always hope the officer doesn't show up and it gets thrown out. I think police officers need to start being held accountable for mistakes and abuse. Agencies need to be developed for strict investigation. I applaud the ones that are great at their job but highly disapprove those with big egos and ridiculous intuitions within their job.
