CAllin all cops!!!

Alright so a few weeks back i got pulled over.

It all started as i turned onto the main street here in the city, something like the boulevard of most places.

i make my turn and notice that theres a bike cop coming up on the far left lane im the the far right, he proceeds to pull up next to me and look in the car all suspiciously like if he knows wat to look for in these cars, i look up and think to myself "WTF?"

Im with my GF and "wacko"(a member here). we get pulled over and we say to ourselves "wtf did we do wrong?"

the cop asks the obvious ? "do you know y i pulled you over?"

i obviusly sed no.

he tells me that im not wearing my lap belt. I was driving an older ford escort with those retarted seatbelts that go over your shoulder automatically wen you shut the door. and the lap belt is seperate.

well needless to say i was completely unaware that it even had a lap belt, and never thought shit of it.

well he proceeds to write me and wacko both a ticket for not wearing our lap belts. and my ticket is about $340 and its my first offense

my question is do i stand a chance to fight the ticket?? i mean i kno i could probably get the fine lowered cuz 340 is pretty steep. but can i get the shit dropped?

sorry for the long post, i just need to know before thursday, im guna be near the courthouse and i figure i might aswell stop by and see if i can fight it if i stand a chance

eh yikes dude. I bet if you argued it at all they'd at least lower the price a little since it's your first ticket. $340 is steep!

It was very common with those belt systems for drivers to forget to engage the lap belt... especially if you are unfamiliar with the vehicle.

That would be your best point of argument.

You were technically wearing a seatbelt...check state law on what constitutes a seatbelt.

You can try and use the "I'm unfamiliar with the car idea" but it might not be the best way to go about it. You could claim that you were wearing it because a motorcycle cop probably wont have a camera and plus they wouldn't be able to see it anyway just the shoulder belt - on the video.

click it tickets are only like 25 bucks a pop over here, but I guess that since you are in the great state of California you will have some retarded fine.

If you know a cop in the department I would try asking them to remove it from record or something like that...if not fighting it in court would be a good idea since the ticket is $340. I wouldn't pay that fine for something so trivial.

WEll shit my cousin is in SWAT but i dnt wana hit em up out of random just to do me that favor you kno. besides hes in a different city than me. idk if it would even be worth it. im guna call and ask em today

Seatbelt tickets are $50 each here. I don't believe they are moving violations so they shouldn't effect your record.

But you need to get that fine down. $340 is way too much. I'd also question how an officer on a motorcycle would be able to see your lap to actually see that it wasn't being used. Could be an unlawful stop.

assuming the officer has been doing traffic enforcement long enough to remember when cars with seat belt systems like this were new, he made an educated guess that the driver didn't have a lap belt on. also, from the number 3 position in a lane, i can see if someone has their seat belt on while sitting on my motorcycle at a stoplight.

Well they got the whole click it or ticket campaign so im guessing yea.

Its jus bullshit IMO how the cop came in and looked then pulled me over. i wouldnt trip so much if the fne was less. but 340 is just fuckin rediculous.
