Fight it or not..Worth it....?

so heres the deal. There was this one on ramp i took to get onto another part of the highway and i slowed down to like 45 and cruised behind my friend for a sec. well i put it in 4th and took off. everything was fine and dandy until i a few seconds after that onramp i got onto another on ramp to get to the main street and a cop decides to pull me over. he didnt even say how fast i was going, the ticket doesnt even say anything on how fast i was going. anyways on the ticket he checked off the little box that says i was going 26+ over the speed limit. in INDIANAPOLIS the limit where i was, was 55. now i doubt i was really going more than 80MPH. i dont have any money to pay this ticket. i googled it and its almost going to be like 6 or 8 points on my record ontop of what i already have wich is alot. im contemplating on going to the court date and trying to fight it.

on one hand i dont have money to pay it and its probably not going to get paid anyways because its probably going to be like $300. on the second hand i know either way im probably going to get my license suspended and im going to cancle my insurance in a few anyways cause i aint got money for that either. even if i pay for the ticket the insurance is still going to kick me off again.

so do i go to the court date or not ?

ive never been to one of those.. anyone got any tips.. on what to do, what not to do, what to say, what not to say..

anyways.. after the ticket i decided to not sit in class and be pissed all day and am here at home trying to think of what to do.

Well, I've got tickets numbering into the double digits. I lost my license for close to a year, and had no idea. Show up at court, it shows character. I always went to mine, and judges are cool. Most likely, the cop wont be there. Unless he wrote 5 questionable tickets in a day, he's not going to pop into court to check on them.

Usually, it's pretty simple. Show the errors on the ticket, and they wipe it off. No speed posted on the ticket? No ticket. At least for me it's been that way (Apparently my car was an 08 Dodge Nissan, and was purple). Errors on the ticket by the cop almost always get tossed. Don't hold me to it. If you want to fight it to get out of it, have it. You say you've got a bad history and you'll get kicked off your insurance and shit anyway. . . so that may not hold up very well in court. That also makes me wonder how fast you were going as well. You did say you "downshifted to 4th and TOOK OFF so that would imply you were in higher RPMs in 4th gear. Faster than 55mph @ that point.

I know this may seem personal, but how don't you have the money? You've bought wheels, continually say you're getting coils, buying little tidbits here or there. Where is all that cash? Saved mod money should be dipped into for a ticket or NECESSARY assets, IMO.

Hmm..

Maybe go fight it, you have nothing to loose. The only thing is you already have points on your license and the Judge will see that. So its you (with past tickets) vs an officer and what he witnessed (the judge wasn't there so he's going to believe in what the officer says).

Maybe find a way to prove you couldn't go that fast in that area. Tell them you drive a dodge neon :lol:

Seriously though, I wish you the best of luck with this situation man.

Number 1 thing to remember: Don't lie.

The judge has your entire driving record right in front of them. They will own you.

This is also true. Feels good to be the honest one after seeing the kid in front of you get a pwned by a judge who will forget his and your name in the first 10 seconds after you walk away.

its ok about the last statement there. i have a car fund money kinda.. like everything ive bought for it has been from what i had left over when buying the car and the whole thing with the blue neon..remember. but i also used some of the extra cash to pay off credit card debts.i do have a job but the check basically goes towards gas money and insurance once a month. i still live at home and my mom is nice enough to not charge me for anything like phone and rent or anything like that. i get along with my parents soo im good in that department.

i remeber shifting into 5th but then i let off the gas pedal. and i dont really think i was going 81 or more. and yes it doesnt say the speed on there. i have to go fight it anyways.. no money even if i had to pay it. yes my record is bad. i just switched to AAA 2 months ago cause state farm kicked me off. and im sure AAA will too. plus not to mention my monthly price will go up if i pay the ticket. guess ill just try to take the this economy sucks route.. and i still got 2 1/2 months of driving back and forth to class wich is a 1 hour trip monday trough friday.. till i graduate in May. anyways im gonna be straight up with the judge i guess.

well like i said.. my friend was in front of me before i took off around him. he was in his Yellow GT mustang..anyways i just spoke with him on the phone and i was like...hey Jason.. how fast do u think i was going.. he said no more than 65 at least.. then i told him the cop noted 26+ and Jason said hell no.

so i might try to get my friend to go into court with me and see if that works as proof

im not that dumd. my last ticket was like august.. yes ive gotten like alot of tickets since ive been traveling back and forth to class.

Well, you're a crappy driver then? I've commuted 4 hours at time for several weekends straight and never gotten a ticket.

Don't get too comfortable with your daily route.

Not sure how it works there but I think in TX you can't take defensive driving if you were going 20+ over.

You don't have money? Don't speed. I don't care if you're trying to keep up with your buddy, or show off in the Peon. Using the "i wasn't paying attention" excuse doesn't work either. You downshifted, and took off. You knew your intentions, and I'm sure you realized just how fast you were going.

Obviously even being kicked from other companies haven't taught you a lesson, and with a bad driving history the judge wont play nice. But, as what's been told, show up, dress nice, be polite, and tell the truth. There's a SLIM chance in hell you'll get out of it, but you may get the penalty reduced.

You should only speed or drive "spiritedly" if you can afford to do so. I've had 9 tickets in my 7 years of driving. 2 are still on my record, about to come off int he next year or so. It took me paying insurance rates of $200+ for a neon to finally realize, it's not worth it. You'll NEVER see me on the road driving more than 5 over the speed limit, and I sure as hell don't "take off" in a car anymore either because I can't, and don't want to, pay for tickets and higher rates.

You're "paying to play" right now. If you can't afford it, don't do it.


But yes. Fight it. Fight every ticket you ever get even if you're guilty. Always go to court for it and speak to a judge. It shows character and sometimes will land you a bit more respect. Good luck.

most definitely go to court. If you don't, you've lost already ;)

Anyway, always keep calm and polite, listen to what's said and keep your answers clean of too much subjectivities and not much longer as strictly necessary. Try to act as if you were defending someone else, if it would help you not to get too emotional.

Oh and what also might help, show remorse. You know you've done wrong and you deserve punishement.

Wow, all you guys are shitty drivers.

I have had a grand total of 2 tickets in 9 years, and don't forget I have driven around 75,000+ miles for work in the last two years. My last ticket was Dec 2006.

You drive a prius, i don't think you can speed in those things.. Unless you're prius is a toyota recall.

It may not have a lot of HP, but it's got too much torque. It can do 80+ mph if needed.

Either way Frank. Many of us have had tickets, but the sensible ones helping Manny now are those of us who don't post up and piss and moan about tickets or warnings or anything lame. Like Josh said, pay to play. I quit speeding, and I don't drive spirited anymore. It's cheaper and I'm not paranoid all the time.

Get a good lawyer and let him pull strings. Come out with a non moving violation with some sort of driving probation.

The thing that sucks is that you have a bad driving record already, so I am not really sure what will happen.

You put it in 4th at 45 mph? Sure you didn't mean 3rd? Also doesn't help to have a bright colored car.

I thought that too, the car doesn't move all that well at that speed in that gear....the acceleration couldn't have been that insane that someone would pull you over for it. Is the exhaust loud? Could have played a role. Either way with a crappy record your best bet is to go to court and give it a shot, see what they say.

Wish I had some input for ya Manny, but I've never gotten a moving violation..

But now that I think about it, you say you were going 45? And put it in 4th? I don't see there being much pickup in that gear at that speed really. If you put it in third, and rang out third, that would be a different story because you would of been going 90+. Unless you stayed in 4th for a while waiting for the revs to pick up, I doubt you saw past 70. But obviously you can't say that to them. Or if your desperate, go for it.

4th gear at a 45mph roll in our cars is like dogshit. You would've had to go pretty far to get up to 80.

Cops like to lie, and they make mistakes.

My last ticket I got, the cop said he saw me go past and had to wait a few minutes before he could pull out to chase me. I never saw him pull out. He said he chased me through downtown and he was doing well over 130 and couldn't catch me. The point where he finally pulled me over was about 4 miles from where he said he saw me drive by. Those 4 miles were stop and go downtown city driving, and I got stopped by almost every redlight.

When he said that, I looked at him and said, you do realize I'm driving a neon, with 4 people in it. You honestly think I could drive downtown at greater then 130 mph???

I didn't want to argue and he gave me a deal so I didn't get points and only a fine.


Best way to go about it is get yourself educated. Find out what the cop is allowed to do, and what has to be on the ticket.

10 years driving, one ticket for 10km (6 miles) over the limit in april of 2004.

That's what I was implying earlier. If you downshifted to 4th and "took off" you'd have to be hitting pretty rad speeds because you wouldn't "take off" for a while.

Crystal.. no exhaust isnt too loud.. well it depends really.

Anthony.. yes it does kinda bog on 4th at 45mph.. maybe i went to third then 4th. i cant remember too good. but honestly the thing is i dont remember going to 5th gear.. cause 4th at 81mph..umm yeah rite. and from the time i downshifted to the time i was to the other on ramp..well its like 1 minute if that really.


well: i got to thinking.. i might have another solution. indy has an online payment option thing. i can wait till the ticket is entered and shows how much i have to pay. they also have a second fee wich if you pay that 2nd fee it doesnt get sent to insurance of the BMV. maybe i can take that route.. but only if its not insanely high.. tho it being 26+ it might be. well wait and see. ill keep yall posted when i get the full ticket price.

Manny, Manny, Manny. Just go to court, don't act like a dumbass, and hopefully you can get the ticket reduced. You've got a lot of strikes against you, so don't be surprised if they throw the book at you. Good luck...

I suggest going to court. Worst case scenario, it's the same cost and point penalty. More than likely, you'll get a lowered fee and little to no points. Especially if your record was clean before this ticket.
