My wife Had a bad day...

She had her Kia all of 5 months. Some dumb arse ran a red light & T-boned her. She is going to be ok thankfully.

It was the other drivers fault. Ive never totaled a car before so what happens next? The other person had full coverage and all that. I owe more than the truck is worth I know that.

Not bad from a Kia Sportage. I didnt know what to expect when I got the call. Im thankful it held up like it did.

We just got out of the hospital and she's getting some sleep. The Doctor & everyone is surprised she wasnt hurt anymore than she was.

What kind of car hit it, to flip it over? :shock:
they msut of been going pretty fast, or those things have rolling problems.

The blue one in the pic. The car hit & went underneath the side of it lifting & rolling it. She wasnt paying attention & never hit the brakes.

We go get her stuff tomorrow so Ill grab a few more pics.

main thing i can say ... is get a lawyer that deals with such things ... it will help you out in the long run ... with the 'settlement' that the other persons insurance offers you ... (reason they call it that, they are wanting you to settle for less then what you should get)

As said above, if you don't get a check from the other persons ins. covering the full cost of your Kia, plus all medical covered, and some extra, you're getting screwed.

Glad it wasn't worse for your wife.

I'm glad your wife is doing well...
I can understand the bad day...

As for insurance: the vehicle is new, you should get a good value out of it, probably be able to pay off the bank loan or replace it outright (one would hope).

Insurance companies are a B**ch to deal with. Ive been dealing with them all day. They send us to a rental car place with no cars, they are trying to see if they can fix her car. Do they not see it? Ugh. Insurance companies FTL.

They'll continue to do that. What company is it? Some companies are better about handling claims then others.

Considering she went into the hospital, you should get, or talk to, a lawyer. Make sure that if she feels any tightening or pain in any of her muscles that isn't normal, she needs to get to a doctor. Because sometimes it takes the body up to a couple of weeks before the effects of her body tensing up finally reveal itself.

Progressive Auto.. Yeah we went to get everything out of the truck. Tow guy said motor locked up on it so it definatly bye-bye. (not like it wasnt before) Ill post picks later. The drivers seat was moved right a few inches.

Yes she is going to go to the Dr. again. Her neck is getting worse as the day progresses. We are trying to get an appt. If not Ill take her back to the ER.

I did find out my payoff is $9200 & the kbb has it retailed at $10075. We were thinking of asking for around $12g so we can have a least $2000 down on another car.

i would get a lawyer ...

you should get the replacement value for the ride .. (IE whatit would take for you to replace it with another car / truck of the same overal condition and value) ... all medical expenses and any other expenses you are out because of thie (car rental, etc) ... plus lost wages because of it ... so i would ask for a lot more then 12k ... you ask for one figure.. they will lowball you with another ... so shoot for about 30k at the least...

but i still say get a lawyer ...

But your insurance should have a lawyer and your insurance usually goes after them for you.

Don't hesitate with the medical issue. I got into a really bad accident quite a few years back and because of it I have permanent nerve damage in my shoulder. I'll never recover from it. I went to physical therapy for two years for it too. The old lady's insurance had to pay for everything, we had a lawyer, but he was a horrible one (was doodling on his legal sized notebook during litigation :beatstick: ). So make sure you get a good one. Maybe ask around with friends and family, word of mouth is really good.

WOW, really glad she is ok. could have definitly been a lot worse.


the thing that sucks about being the victim is that you will probably get screwed unless you get a lawyer. my dad got hit by a kid that ran a stop sign or light. totaled his car. it was a major hassle for him on his own. maybe if he got a lawyer it would have been better.

as for the lawyer, get one. my friend was rearended and his car was totalled (2002 accord). he got a lawyer which he didn't have to pay for until the case was WON. although he charged almost 30% of the settlement :shock: , but the settlement was after the other persons insurance had payed blue book value for his car. so basically he got a check for like $14k for his car and then after a couple of months of physical therapy (which he didn't really need-but keep in mind that i'm not a doctor :D )he got another check, this one for $34k... he still had to pay the lawyer and for the physical therapy from there, but he ended up with like an extra $15k. so like people said GET A GOOD LAWYER
