Round 2 with my car *Officially Totaled*

Little story here...
I was on my way to get gas 2day after work. There was a school bus making a left hand turn. So i slowed down to pass on the right (which there was plenty of room). I started to do past the bus doing about 25mph and BAM! t-boned another car.
We were both ok nothing wrong ('cept for the cars). Neither of us were really pissed. We were kinda joking about it. He said that he had be sitting there for a while waiting to cross the intersection and that the bus driver waived him along to cross the street not checking that their maybe a car coming.
The cop came and it was easy as hell we both gave our info and were on our way. He only lived right around the corner from where i hit him so he drove home and I got to watch my car get put onto a flatbed. My car was 'drivable' no leaks.
I have to give the garage a call tomorrow morning and figure somethings out.
But their is a + and a -.
- Don't have rental on my insurance
+ only have a $100 deductable

Keep this in mind....
You file an insurance claim, there probably going to total the car....
Neons surviving front end collisions like that does not happen often....

That's what i really want to see, if it's totaled or not. I smacked a deer a couple years ago and the car wasn't totaled. But we will have to see. If it is... it's time for another 2gn and a buy back of this car.

God forbid it be totaled. I would buy another 2gn and prolly put most of the shit from my car into the other. Kinda like my way to recycle

Glad your okay man! And Hey, there is another plus, at least it sounds like there is one.... Your not at fault for the accident. Just because another driver waves someone through does not mean that you have the right away. So as long as being on the right side of the bus was legal and your speed was reasonable, the other party is liable... Rental cost become theirs then.

actually, isn't it technically illegal to wave somebody through? cause that's ensuring their safety and a nobody but a traffic cop is in the position to be judging who's safe to go. so whouldn't the bus driver be at fault?

well it wasn't really the shoulder of the road... there was no white line to cross and the road was paved where a drove around the bus, cars usually park there. So my insurance said that i was more than likely not at fault...
I just want to wait and see (prolly call tomorrow) who would be at fault, so i can get my rental from the other guy.

In Canada if it's paved on the right hand side of the vehicle it's legal to pass on the right (aka if the bus was in a left hand turn lane). If you were impatient and were going on the right when there wasn't a 'through' lane meant for passing on the right, then I think you'd be in the wrong.
EDIT: just read your post. So you're saying they were parking spots? I don't think parking spots qualify as 'passing' lane.
Sorry to hear about your luck dude, hopefully it's fixable.

in wisconsin as long as you don't leave the paved surface it's legal to pass. then again, even if somebody hits my car in a parking lot i'm 5% at fault

In ny if you pass anyone by crossing the white line, or where the white line would be, your in the wrong. but i guess it depends on the state. but it sounds like your in the wrong, but if insurance thinks the other way i wouldn't complain. good to hear everyone was ok tho!

^Bingo!
The 'parking spots' were not marked with paint it's more or less just another lane to the road where people park. I Will try to get a pic of the road sometime soon

NYS, passing on the shoulder is Illegal(on the right)
I hope the bus was in a turning lane when you passed him....
Ive seen to many accidents with people passing schoolbuses here in WNY, enough to where I dont even bother myself, I'll wait the 30seconds...

Still waiting though to hear back from the insurance guy who totaled my car, so i can find out how much i could buy it back for.
Still waiting on the police report to get done so i can see who is liable, so i can see if i can get a rental car off of the other guy

The front bumper would have to go and the SRT catback would have to get worked to fit in better (I think thats an SRT catback)

I figured it would be....
No the car is going to be tagged as "Salvage" and if you were to repair it you will have to go through hoops to get the title cleared, or atleast you would here in NY.
One thing that pisses me off when it comes to insurance companies is how that cant take "Your" car and force you to buy it back if you want it after an accident. Its "My" car, why should I have to buy it back?
Damn insurance companies...
