His wife didn't even have an emergency, the car was not insured, or plated, but since he took the wires off to keep her from driving it, (because he knew she would), he went to jail for three days, and ended up paying $3000 in fines.

The ER scenario is exactly the grounds they charged him with. ;)
It does not matter if she can legally drive it. But hey, we need the entertainment. Carry on...

Pretty much. Ill just sit and wait for the "oh man, just got arrested... what to do?" thread. lol

And of course, itll turn into a "I hate cops" thread soon thereafter.

Men - this is really crazy I think or are you kidding ??
For the things you mentioned I am really happy to be a european
Overhere it doesn´t matter if you are imobilizing the car and what therefore maybe could have happend sometimes if this and then and that and so on.
Think you could go into jail for hiding her shoes and she needed to walk to the hospital ...

i can remember you americans debating and demonstrating in the streets AGAINST health insurance obligation for everybody.
That would NEVER happen here in Germany:
If i need an ambulance - i will call one.
And they will come in no time and pick me up.
The insurance will pay - and i don't have to pay in advance.
All i need is that little plastic card from the insurance and i am fine.

(There are some exceptions: if it is no emergency i may have to pay some charges for the transportation. Like: i need an operation and transportation must be lying. So i call the ambulance, they bring me to the hospital and i have to pay something for it.)

Next thing (and more on topic) is:
If the car is not ready to drive, not insured or in "dangerous" condition (no brakes or whatever) you are BOUND to immobilize the car against unauthorized access.
Imagine: Brakes are not working, car is not insured and the wife crashes into a gas station and causes damages in the millions and some death people.

So who do you think will go to jail and who has to pay for the damages?
The wife or the guy who grossly negligent allowed the access???

Btw: we also have car insurance obligation here. So if the car is not insured it is forbidden by law even to leave it parked in public and for driving it you could go to jail. And you could even go to jail (or get in deep trouble) if you intentional allow the access or grossly negligent do not avoid it!

(okay, that was a lot of dictionaring - i hope i made it correct!)

In the real life example I gave earlier, The police would have rather let her drive the car as is. Basically she cut's her own throat, and takes her husband down with her. Any innocent bystanders are just the icing on the cake.

Sadly, that is our legal system. Reaction to action, punishing for preventing action.

All of these emergency type situations are one thing... and legally speaking, include more 'gray' area in the roll of law enforcement.

However, the ACTUAL case the OP is getting at, is a domestic dispute, where he is refusing access to a vehicle. Both him and his girlfriend own the vehicle, and they both have shared access to it. He has no more right to prevent her from driving the car, as she has preventing him from driving it. In many states, 'domestic dispute' and 'domestic violence' calls REQUIRE a law enforcement officer to make an arrest. They have no choice, the law is written as "You SHALL arrest..." And who do you think is going to get arrested? The crazy bitch of a girlfriend who wants to leave the situation in the car.... or the controlling boyfriend who is denying access to the said shared property vehicle... which would probably be the reason the police were called in the first place.

There are things he could do to prevent the 'guy friends' from messing with it, but those tactics will probably land his girlfriend in jail too, if he doesnt also drop the charges against the 'guy friends'

Bottom line, HE does NOT own the vehicle. It is SHARED property between two people. (license/registration/insurance aside, doesnt matter if she has a DL or not in this situation. In fact, in many states, the "victim" of the domestic will not be charged with driving without a license, or insurance, or anything else, if they were driving to escape the disturbance).

In all seriousness, sign the car over to her, and get the hell out of a relationship where something like this is even thought of. I wrote off 3 vehicles in a similar situation (2 neons, and a mustang, and a shit load of parts and money into them). Whatever you loose in vehicles, is more than made up for in mental health and happiness. You are way too young to live so miserable in a relationship thats not going to last much longer anyway.

Ugh, Ive handled way too many domestics....
