This really shouldn't be so surprising though. The new airbag systems can actually vary how hard they deploy based on how fast you're going. It needs to know how fast you're going so of course it's going to monitor your speed, among other things. But like any mechanical/electrical system it's subject to malfunction.
The problem isn't the airbag module. It's the dumbasses that think it can solely be used as cold hard evidence to lock someone up in spite of expert analysis. If he really was going as fast as the module said, if he wasn't dead the other car would have been destroyed much more than it really was. To put that in perspective he was going about 14 MPH MORE than the porsche that rammed into the toll booth.

to continue with fixitmattman's statment... what about the lady that slid on ice.... um.. correct me if I'm wrong, but if your slipping, the speedometer is going to read something other than what is really occuring. I know when my wheels spin on wet pavement, my car says I'm going faster than I"m really going....

You can't not have it though. You can pull it out after the fact and disable the airbags but I'm pretty sure airbags are required by law now.
