KIND OF PISSED!!! (MORE)

ok so im gonna rant a lil bit and yall let me know if its wrong to feel this way...

so about a month and a half ago me and the fam moved into a new apartment, and the 1st night we were there the lady downstairs threw a fit cuz of the noise. (we were putting the babies bed together at like 8:30) since then she has been bitching to the landlady about noise, where i park, us having people over, u name she has bitched.

now a lil bit about her she is about 50 and is partially crippled (or just lazy as fuck i havent figured it out yet) she is in a wheel chair 80% of the time but ive seen her walking and she drives.

we live on the second floor and she will literally park her chair right in front of the stairs and not move when we come walking up, even after we say excuse me. for lack of a better term she is a BITCH...

now i have seen her on many occasion pull up next to the 1gn and open her door into the side of the car and ive asked her nicely to please not do it. so i started parking the R\T far away from her and well she has still been parkin by it. well today i was just looking at the car and the whole passenger side of my car has dings and green paint all over it. IM SO FUCKING PISSED!!!

should i confront her or let the landlady know that she needs to do something because she has no respect. i know if i say somethinn to her she will deny it and that will just piss me off and i have a very bad attitude and i would hate to have to push this bitch in front of a bus...

so what should i do???

do you guys have a noise curfew after a certain time? i know i do at my apt, after 11 you are suppost to be quiet before that, it doesnt matter and mngmt isnt going to do anything about it. Thats just a shitty deal man, i doubt that complaining to the mngmt is going to help. Shes going to bitch no matter what. As for your car, thats a matter for police honestly, you can prove it, just match the paint to her car.

as for the car i was thinking of calling the police, and also taking pics of her doin it. but would that be invasion of privacy??

It works the same way as an accident. You file a police report, get her insurance info. Her insurance sends you to a body shop in their "network". They do an estimate. If you like the result, you take the money, and it's done. If you don't, you can ask for more estimates. Keep in mind the insurance company wants to pay just enough not to get sued.

If it wasn't for the kidnapping charges/attempted or successful murder charges/being slaughtered by the media, it might be worth it.

Edit: Erick, IDk if her insurance would pay, if she is intentionally doing it out of malice. It becomes a criminal act at this point. Most insurance companies won't cover damages caused in a criminal act. It is their sneaky little way of not paying.

Well, of course, but she's not going to admit vandalism. By that measure, common traffic accidents would sometimes not be covered because of the driver's negligence.

Negligence. Either way, you're covered. She damaged your stuff, so she's obligated to make you whole. Call the non-emergency police number, and have them dispatch a car. Just let them know all the details about the actual damage. Speak in facts, not in opinions and emotion. Don't even bring up the fact that you know who owns the car that is damaging yours. The cop will likely pull up the tags, get the address, see it's in your building, and knock on her door to get her "side" of things. She will claim ignorance. Make sure you can see that the damage has been caused by her car and photos for evidence.

Then she will be issued a ticket of some kind. Any kind really. It doesn't matter. It just puts the law on your side, and basically defines her at fault. She will call her insurance and let them know of the incident. Then you will call them and schedule an estimate.

The other way it can go down is that the cop refuses to write a ticket because there is no evidence, and then your only option is to either wait until it happens again and call the cops again, or go after her in a civil suit.

I would call your local PD and rationally explain to them that she is harassing you. Give them all the details about her damaging your car, etc. and say you don't want to cause any issues but it's getting out of hand when you try to carry your children into the house and she refuses to move on top of the damage to your car.

Ok here it goes.

If you choose to go the legal way, wait it out and purposely park next to her, then film her smacking the door. The more evidence you can gather, the better. This is the only way you will be able to prove that it is hers. No insurance company is going to pay for damage that may not have been their clients fault. It's hard enough to get them to pay when it is clearly their fault. And they especially aren't going to investigate the situation with the info you can give them. One's word doesn't go as far as it used to. The police might laugh at you honestly if you called them.

If it were me, I'd probably crawl under her car and have a little fun. Nothing dangerous, just maybe do some "rewiring".

You know, as much as this friction from your neighbor has upset you, "getting even" as some here have suggested will only put you on her level. If the paint on the dings in your car matches her car, I would think that your apartment management would do something about the situation if you present your complaint calmly. Capturing on video her opening her door into your car will certainly help your case. My .02 worth.

well im definitely goin to park next to her on purpose and get some pics of her doin it. i mean the car is already fucked up now whats a lil more gonna hurt.

see i honestly dont think the police will do anything because ive already seen the cop that they would send up here at her apt. talking to her and havin a good ole time...

not to mention the local PD hates my car. so i guess ill take pics of all the damage and try to get her on camera doin it.

O and u have no idea how many fantasies ive had about fuckin this cripple bitch up, im glad you all were sayin shit like that i kinda felt bad for feelin like that since she is handicapped.

another thing im gonna try to bring up is the fact that there are handicapped parking spots in front of all the apt. buildings except ours which is dumb since ive never seen any other handicapped people anywhere

get as much data and examples as possible and keep track of 'incidents' like the stairs one. Let the landlady know how you feel and present her the data and just wait. There's not much you can do which does not discredit you i am afraid..

i know how you feel man... first week i had my car some dickbag hit side swiped me driving home drunk (or elderly im not really sure) and didnt leave a note or anything...... I walked around the parking lot and matched the paint on my car to his car and found E-blue paint on his bumper.... csi ftw
