2 Tickets, Would like your opinion

Post by RobsProjectSOHC » Wed Nov 30, 2011 11:34 pm

So, on my way home from work.....coming up to an orange light, near to be under the lights. (btw this stop has a stop sign + line further back that next to lights, for truckers to do a wide turn. ill take pics soon.). As I was in that position the light turned red, i was in traffic so i was going my way and a cop did a u and pulled me over. Said i ran a red light. From where he was, he could not tell if the light was facing my direction.

Next ticket is gunna be the doooozy. lol. So, i dont have my id on me. Cop ask me my name, bod, blah blah. Goes to his car, comes back, "WHATS YOUR REAL NAME!" How do you react to that? Someone telling you your name is not your name. So after trying to calm to officer down (very cooperative, did volunteer for rescue squad and learned my lesson speeding and did my dues with deffesive drive courses) he tells me he cant find me in the system. Gives me a ticket. + Cop was very rude when I was nice the whole time.

My questions are:
A: If im not in the system, then who are those tickets made out to?
B: If anything, shouldnt I be in jail fingerprinted. What if I killed some one and was getting away?
C: Should i get a lawyer or just take the pics and hope they take me seriously.
D: Am I over thinking this?

Regardless, I find paying a lawyer do the work is cheaper in the long run

I'd say that's running a red light. I'm a little confused on the last part though. You said he made a u-turn which means he was most likely looking at the light as he would have to be on the same road as you. Not to mention you said this light also has a stop sign?

Can't answer the last one because I'm not sure. I'm sure you're in the system (since you have priors), but he possibly couldn't type it in correctly. I have no clue how your last name is spelled or if you spelled it out for him.

I am a little  on there also being a stop sign. As far as I have seen, there is either a traffic light or a stop sign. Not both.

its a 4way, so
[cop]=||= -(The intersection)
.......||= - The stop sign with light.
[where cars should stop]

Its just extended down so truckers can get a huge wide turn out of it. ill take pics soon.
I was past that line, which technically puts me in traffic, while the light was yellow.

Now my job is suggesting i step down from management because i cant drive my car now. (since im not in the system apparently. At all, i spelled it out and everything.)

Uhhh did you lose you license? Because unless you lost your license I don't see why you can't drive. Just carry your license with you and then the officer can punch in all the info he wants.

Your job sounds super sketchy if they're asking you to step down over a normal traffic stop, unless your job absolutely REQUIRES a clean record like my job, which even then gives leeway on some violations. However, you didn't state what the second ticket was for...

1) you ran a red light, you got a ticket. Take it like a man. I know, it was yellow when you crossed the stop-line but how long was it yellow already? I don't know how US law is in this perspective but Dutch law states you have to have left the intersection before the light turns red.

2) what did you get the second ticket for? not having ID on you? if so: you didn't have ID on you and you got a ticket. Take it like a man.

Or am i missing some vital points? :tardbang:

Technically here in the states, if you don't have id/drivers license on you. Then you are driving without a license. Which is illlegal to do so. It needs to be with you whenever you drive.

I've been pulled over without an ID (although "in the system") and I had 24 hours to prove I had one.

1. I didnt run a red light or else i wouldnt be posting of how dumb i could be. Trust me, when i couldnt see the light anymore, it was still yellow. Dont wanna download google earth (not my comp at the moment) but i will take pics soon.

2. My license was suspended previously but was all taken care of. Have papers. I paid my dues.
I told him that i lost my license and i have one coming in the mail. i just lost the temp paper mixed with other receits and stuff i accidently threw out.

Usually when an officer suspects you of giving a false ID/name, you are directly cuffed and stuffed.

Giving him your SSN might have worked better. Altho be sure it's yours, or see above.

You may want to get a lawyer/pictures/proof of valid license. In the end you may pay court cost, and have the fines penalties dropped.

I would check the spelling on your vehicle registration. Possibly that's where he had a valid point. If he ran your plates, which I'm 100% positive that happened, he may have used that to check against what you were telling him. If it didn't match, it isn't his fault.

The limit line for the intersection is set farther back as you say for trucks to be able to make the turn. You need to be going through the intersection as the light turns red; not going over the limit line. If it was an extended distance to the intersection, and you weren't travelling through the intersection before the light had turned red, you ran the light. Say it takes an extra couple of seconds for you to make it through the intersection in your situation. There could be oncoming traffic traveling in the opposite direction, that did not have to stop at the red light, that you are now driving right into the path of. That couple of seconds lost is how a lot of intersection accidents happen. :)

Lesson learned I'd say. Wait an extra couple of minutes for the light to change again.

You guys are too on the fact of running a red light. Ive drove for a year without a license. been followed and etc. Not trying to sound bad ass, its more of...i learned how to be patient with my driving and i pull over to let tailgaters go by. Ill give it to the cop, from where he was, it might have looked like i have. But he would not even consider or let me say anything. thanks for your opinions though.

Show them other documents you have with you that have your
name on them. No other documents?

Calmly given them your full name again. Offer to write it out so
there are no verbal communication mistakes.

Those without a license in the system get tickets... made out
to them.

If the officer suspected that you would not be posting now.
C: Should i get a lawyer or just take the pics and hope they take me seriously.
Officers always take each traffic stop seriously because they
don't know what they will encounter.
D: Am I over thinking this?
Yes, pay the fines and get legal.

I meant over thinking like too worried i was gunna lose. Honestly you guys can think i ran the red light, you dont know 100%, just like the cop. Thought you guys would have been smarter on this and more helpful on how to prove my innocence...instead of claiming me guilty. Cops are power hungry animals who feel like with a little bit of power they are above the law. Deal with it.

Get a picture of the intersection for us to understand your situation better. But as someone else said ... for him to do a u-turn to come back to you ... he could have been looking at the light you were going thru ... but he may not have had a clear view of where you were and might have thought u ran it.

As far as the license issue ... I think you should take that up with the dmv to find out about your license ...

I did check with the DMV the next day, got it all taken care of. Glitch in there system. He did a u turn in the middle of the intersection, without his lights on and never turned them on. The pics will explain it all
